Terms and conditions

The terms that apply to pest control, inspection, treatment and related services provided by 4S Pest Control.

These Terms and Conditions apply to all pest control, pest management, inspection, treatment, prevention and related services provided by 4S Pest Control ("4S Pest Control", "we", "us" or "our") to customers ("you", "your" or "the customer") throughout Melbourne and surrounding areas.

By requesting, booking, approving or accepting our services, you acknowledge that you have read and agree to these Terms and Conditions.

These Terms and Conditions are intended to operate in accordance with the Australian Consumer Law (ACL) and applicable Victorian legislation. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer guarantee, right, warranty or remedy that cannot legally be excluded, restricted or modified.

1. Our Services

4S Pest Control provides professional pest management services for residential and commercial properties. Our services may include general pest control, cockroach treatments, ant treatments, spider treatments, flea treatments, wasp and bee related pest services, mice and rat control, termite inspections, termite treatments, termite prevention and protection, pre construction termite management solutions, possum and wildlife related services where legally permitted, bird pest management where legally permitted, pest inspections, preventative pest management programs and other pest management services agreed between the customer and 4S Pest Control.

The exact service provided will depend on the pest species, level of infestation, property conditions, access, environmental conditions and recommendations made by our technician.

2. Quotes and Pricing

Where possible, 4S Pest Control will provide a quote or estimate before commencing work. A quote may be based on information provided by the customer, photographs, measurements, an inspection of the property, site conditions or other information reasonably available to us.

Unless specifically stated otherwise, a quote covers only the services, areas and treatment described in the quote.

Additional charges may apply where the customer requests additional services, additional treatment areas are identified, the pest problem is materially different from the information originally provided, access to the property is more difficult than reasonably expected, additional equipment or labour is required, additional treatment is necessary, site conditions require additional work, or the customer requests work outside the original scope.

Where reasonably practicable, we will inform the customer of additional charges before carrying out additional work.

3. Booking and Acceptance

Bookings may be made through our website, email, online booking system or another communication method accepted by 4S Pest Control.

A booking is considered accepted when 4S Pest Control confirms the appointment or otherwise agrees to provide the requested service.

The customer agrees to provide accurate and complete information regarding the property, pest problem, previous pest treatments, access requirements, occupants, pets, animals, known hazards and any other information reasonably required for the safe and effective provision of our services.

4. Access to the Property

The customer must provide safe and reasonable access to all areas requiring inspection or treatment.

If our technician cannot reasonably access the relevant areas, we may be unable to complete the service or may need to reschedule the appointment.

Where a return visit is required because reasonable access was not available at the agreed appointment time, an additional attendance or service charge may apply where permitted by law and disclosed or agreed.

The customer is responsible for ensuring that our technician can safely enter and work at the property.

5. Preparation Before Treatment

Certain pest treatments require preparation before our technician arrives. Depending on the treatment, the customer may be required to remove or cover food, remove pets from treatment areas, keep children away from treatment areas, clear access to walls, cupboards, floors or other treatment areas, cover or remove sensitive items, vacate treated areas for the specified period and follow any preparation instructions provided by our technician.

Failure to follow preparation instructions may reduce treatment effectiveness or require additional treatment.

Where preparation is necessary, our technician will provide reasonable instructions relevant to the particular service.

6. Safety and Pest Control Products

4S Pest Control uses pest management products and treatment methods in accordance with applicable laws, product labels, safety requirements and professional practices.

Customers must follow all instructions provided by our technician regarding re-entry times, ventilation, food and food-contact surfaces, pets, children, aquariums, treated areas and other safety precautions.

Customers must inform us before treatment of any circumstances that may reasonably affect treatment safety, including the presence of pets, animals, aquariums or other relevant conditions.

We may refuse, postpone or modify treatment where we reasonably consider that the proposed treatment cannot be performed safely or lawfully.

7. Treatment Results

Pest control is a biological and environmental service, and results can vary depending on the pest species, infestation level, property conditions, hygiene, sanitation, surrounding environment, weather, building construction, access points and other factors.

While 4S Pest Control will use reasonable care and appropriate treatment methods, we cannot guarantee that all pests will be eliminated following one treatment, that pests will never return, that pests will not be present in untreated areas, that pests will not enter the property again, or that treatment will prevent all future infestations.

Where appropriate, our technician may recommend follow up treatments, monitoring, baiting, pest proofing, sanitation, building repairs or other preventative measures.

8. Follow-Up Treatments and Service Warranty

Where a service includes a stated warranty, guarantee or free follow up treatment, the warranty applies only to the pest, property, treatment areas and period specifically stated in the relevant quote, invoice, service agreement or treatment documentation.

A warranty does not automatically apply to every pest species or every area of a property.

Unless otherwise stated in writing, a warranty may not cover a different pest species from the pest originally treated, new infestations, untreated areas, inaccessible areas, pest activity caused by structural defects or untreated entry points, unsanitary conditions, food sources, external pest pressure, weather or environmental conditions, failure to follow treatment instructions, interference with pest control devices or bait stations, or circumstances outside the reasonable control of 4S Pest Control.

Where a follow up treatment is included, the customer must contact 4S Pest Control within the applicable warranty period.

Nothing in this section limits any rights or remedies available to the customer under the Australian Consumer Law.

9. Termite Services

Termite inspections and treatments require particular care because termite activity can be concealed and may not be detectable in every part of a property.

A termite inspection is not a guarantee that termites do not exist or will not subsequently occur.

Unless expressly stated in writing, a termite inspection does not constitute a structural building inspection or guarantee the structural condition of the property.

Customers should obtain appropriate building, structural or specialist advice where required.

Termite treatments may include chemical barriers, baiting systems, monitoring systems or other appropriate treatment methods depending on the property and circumstances.

The effectiveness and longevity of termite protection can be affected by building design, renovations, landscaping, soil conditions, plumbing, drainage, moisture, structural changes, new building works, breaches of termite barriers and other environmental or construction factors.

Customers should not disturb, remove, modify or interfere with termite treatment systems without appropriate professional advice.

10. Rodent and Mice Treatments

Rodent and mice control may involve traps, monitoring devices, bait stations, exclusion recommendations and other appropriate treatment methods.

Effective rodent management may require the customer to address food sources, rubbish, harbourage and potential entry points.

4S Pest Control cannot guarantee that rodents or mice will not enter or re-enter a property where suitable access points remain available.

Customers must not move, open, interfere with, damage or dispose of pest control equipment supplied or installed by 4S Pest Control unless instructed to do so by our technician.

11. Wasp, Bee and Wildlife Services

Some animals and species are protected by legislation or subject to specific handling requirements.

4S Pest Control will only provide services that are legally permitted and within the scope of our applicable licences, qualifications and insurance.

Where a pest or animal requires specialist wildlife handling, relocation or another service outside our scope, we may recommend that the customer contact an appropriately licensed specialist.

12. Customer Responsibilities

The customer is responsible for providing accurate information, providing reasonable access to the property, following preparation instructions, following treatment and safety instructions, informing us about relevant hazards, keeping children and animals away from treatment areas where instructed, not interfering with pest control equipment, maintaining reasonable hygiene and sanitation, addressing structural or maintenance issues contributing to pest activity and advising us of relevant changes to the property.

Failure to meet these responsibilities may affect treatment effectiveness and may result in additional services or charges where reasonably required.

13. Pets and Animals

Customers must advise us about pets, livestock, birds, fish, aquariums or other animals that may reasonably be affected by treatment.

Unless otherwise agreed, pets and animals must be kept away from treatment areas in accordance with instructions provided by our technician.

Customers remain responsible for following all safety instructions provided in connection with the treatment.

14. Children and Occupants

Children and other occupants must be kept away from treatment areas where instructed.

The customer must follow all re-entry, ventilation and other safety instructions provided by our technician.

15. Cancellation and Rescheduling

Customers should provide as much notice as reasonably possible if they need to cancel or reschedule an appointment.

Where an appointment is cancelled at short notice, the customer does not provide reasonable access, or our technician attends the property and cannot reasonably commence the agreed work, a reasonable cancellation, attendance or call out charge may apply where such charge has been disclosed or agreed and is permitted by law.

Any cancellation charge will remain subject to applicable consumer law.

16. Delays and Unforeseen Circumstances

4S Pest Control will make reasonable efforts to attend appointments at the agreed time. However, appointment times may be affected by traffic, weather, emergencies, previous jobs taking longer than expected, unsafe site conditions, access problems, equipment issues, supplier delays, government restrictions, natural events or other circumstances outside our reasonable control.

Where practical, we will notify customers of significant delays and seek to reschedule the service where necessary.

17. Payment

Payment is due in accordance with the invoice, quote or agreed payment terms.

Accepted payment methods may include electronic funds transfer, online payment, credit or debit card or other payment methods accepted by 4S Pest Control.

For commercial customers, different payment terms may apply where agreed in writing.

Where payment is overdue, we may suspend future services until outstanding amounts are paid, subject to applicable law.

18. Additional Work

Our technician may identify additional pest activity, access issues, structural conditions or other circumstances requiring work outside the original scope.

Where additional work is material, we will seek customer approval before proceeding and will advise of applicable additional charges.

Minor additional work reasonably necessary to complete the agreed service may be carried out where appropriate.

19. Property and Pre-Existing Conditions

Customers must inform us of known defects, damage, fragile property or other conditions that could reasonably affect the service.

4S Pest Control is not responsible for pre-existing damage, defects or conditions that were not caused by our services.

Where a condition presents a risk of damage or creates unsafe working conditions, we may recommend that the customer address the issue before treatment.

20. Damage and Liability

4S Pest Control will provide services with due care and skill and in accordance with applicable legal requirements.

Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited.

Where permitted by law, 4S Pest Control is not responsible for loss or damage caused by circumstances outside our reasonable control, pre-existing conditions, customer actions, failure to follow reasonable instructions, or conditions unrelated to our services.

Where damage is alleged to have been caused by our services, the customer should notify us as soon as reasonably practicable so that we can investigate the circumstances.

21. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms and Conditions is intended to exclude, restrict or modify those rights.

Where a service does not meet an applicable consumer guarantee, the customer may have rights to a remedy depending on the circumstances.

These Terms and Conditions should be read together with any rights and remedies available to the customer under the Australian Consumer Law and applicable Victorian legislation.

22. Refunds

Refund requests will be assessed in accordance with these Terms and Conditions and applicable Australian Consumer Law.

Where a service has been properly provided and the customer simply changes their mind, a refund may not necessarily be available.

Where a customer is legally entitled to a refund, replacement service, rectification or another remedy, 4S Pest Control will comply with its legal obligations.

23. Complaints and Disputes

If you have a concern about our service, we encourage you to contact 4S Pest Control as soon as reasonably possible.

We will make reasonable efforts to investigate complaints and, where appropriate, rectify issues.

Complaints should include the customer's name, property address, date of service, invoice or booking number where available, a description of the concern and any relevant photographs or supporting information.

We will endeavour to respond within a reasonable period.

Nothing in this section limits any rights a customer may have under the Australian Consumer Law or other applicable legislation.

24. Commercial Pest Management

Commercial customers may be required to enter into a separate service agreement.

Commercial pest management programs may include scheduled inspections, monitoring stations, pest activity reporting, preventative treatments, documentation, recommendations, emergency call outs and other services agreed in writing.

Commercial service agreements may contain additional terms relating to service frequency, pricing, reporting, access, payment, warranties and termination.

Where a separate commercial service agreement exists, that agreement will apply to the extent of any inconsistency with these general Terms and Conditions.

25. Photos and Treatment Records

Where reasonably required, 4S Pest Control may take photographs or maintain service records for purposes including documenting pest activity, recording treatment areas, monitoring pest activity, preparing reports, demonstrating work completed, quality assurance, customer service and regulatory or operational requirements.

Any personal information collected will be handled in accordance with our Privacy Policy and applicable privacy laws.

26. Privacy

4S Pest Control may collect personal information necessary to provide quotes, bookings, pest control services, invoices, customer support and related business functions.

27. Website Information

28. Intellectual Property

Unless otherwise stated, content on the 4S Pest Control website, including text, branding, logos, graphics, photographs, videos and other materials, is owned by or licensed to 4S Pest Control.

You must not reproduce, copy, modify, distribute, publish or commercially exploit our website content without our written permission, except where permitted by law.

29. Third-Party Services

Where we recommend or refer a customer to another service provider, that provider may operate independently from 4S Pest Control.

Unless expressly agreed otherwise, 4S Pest Control is not responsible for services supplied independently by third party providers.

30. Changes to These Terms

4S Pest Control may update these Terms and Conditions from time to time.

The current version published on 4spestcontrol.com.au will apply to future bookings and services, subject to applicable contractual and legal requirements.

Any changes will not remove or reduce rights that cannot legally be excluded or modified.

31. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.

32. Governing Law

These Terms and Conditions are governed by the laws applicable in Victoria, Australia.

Any dispute will be subject to the applicable courts and tribunals having jurisdiction in Victoria, subject to any rights available to the customer under applicable law.
